Acceptance of terms

These Terms of Service ("Terms") govern your use of the Days In Color app and this website, provided by SwiftVisions LLC ("we", "us", or "our"). By downloading, installing, or using Days In Color, you agree to be bound by these Terms. If you do not agree, please do not use the app or this website.

License to use

We grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use Days In Color for your own personal, non-commercial purposes, in accordance with these Terms and any rules set by the platform from which you obtained the app. You may not copy, modify, distribute, sell, or lease any part of the app, or reverse engineer it, except where such restriction is prohibited by law.

Your content

You retain full ownership of the canvases, colors, marks, points, notes, and any other content you create in Days In Color. We do not claim any ownership of your content. You are responsible for the content you create and for keeping your own backups where appropriate. Because your content is stored only on your device, you understand that loss of your device or deletion of the app may result in loss of that content. The app's export feature lets you save your own backup copies.

Privacy and usage analytics

Our Privacy Policy explains how we handle information. In short, what you record stays on your device and is never sent to us. To help us improve Days In Color, the app shares anonymous usage information, such as which screens and features are used, which never includes your content. You can turn this off at any time in Settings › Privacy.

Acceptable use

You agree to use Days In Color only for lawful purposes. You agree not to:

• Use the app in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to our systems or interfere with the proper working of the app.
• Use the app to store or transmit material that is unlawful or infringes the rights of others.
• Misuse the contact form, for example by sending spam or malicious content.

Purchases and subscriptions

Days In Color is currently free, with no purchases or subscriptions. In the future it may offer optional paid features, one-time purchases, or subscriptions. Any purchases are processed by the platform's app store, and your purchase is also subject to that store's terms. Prices and offerings may change over time. Where a subscription is offered, it will renew according to the terms shown at the time of purchase unless cancelled, and you can manage or cancel it through your app store account settings. Except where required by law, payments are non-refundable, and refunds are handled by the app store, not by us directly.

Availability and changes

We work hard to keep Days In Color available and reliable, but we provide it on an "as is" and "as available" basis. We may add, change, or remove features, and we may update or discontinue the app or website at any time. We are not liable to you for any modification, suspension, or discontinuation of the app.

Intellectual property

The Days In Color name, logo, design, visual style, and all related software and materials are owned by SwiftVisions LLC and are protected by intellectual property laws. These Terms do not grant you any right to use our branding without our prior written permission.

Disclaimer of warranties

Days In Color is a personal reflection and tracking tool. It is not a medical, psychological, financial, or professional advice service, and it should not be relied upon as such. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error free, or completely secure.

Limitation of liability

To the fullest extent permitted by law, SwiftVisions LLC and its owners and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, Days In Color. Our total liability for any claim relating to the app will not exceed the amount you paid us, if any, for the app in the twelve months before the claim.

Termination

You may stop using Days In Color at any time by deleting the app. We may suspend or end your access to the app if you violate these Terms. Provisions that by their nature should survive termination, such as ownership, disclaimers, and limitations of liability, will continue to apply.

Governing law

These Terms are governed by the laws of the United States and the state in which SwiftVisions LLC is established, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located there, unless otherwise required by applicable consumer protection law.
